In a recent development, Justice Inyang Ekwo of the Federal High Court in Abuja has dismissed a suit filed by human rights activist and lawyer Olukoya Ogungbeje.
The suit aimed to compel the Code of Conduct Bureau (CCB) to investigate and prosecute the 2023 presidential candidate of the Labour Party (LP), Peter Obi, over alleged breaches of asset declaration.
Justice Ekwo struck out the case, citing a lack of diligent prosecution on the part of the applicant.
Ogungbeje had sought an order of mandamus to compel the CCB to investigate and prosecute Obi for alleged failure to declare offshore holdings and associated assets, operating a foreign account while in public office, and serving as a director of Next International (UK) Limited during his tenure as the governor of Anambra.
Despite Justice Ekwo’s earlier grant of an ex-parte motion on November 1, ordering Ogungbeje to file his application within seven days and serve the CCB, the matter was dismissed when neither the applicant nor his lawyer appeared in court on the scheduled date.
