A Washington firm, Von Batten Montague York says it received a huge amount of records and is carefully going through them and redacting where it sees fit. The firm posted portions of the FBI’s own sworn declaration submitted to the court on August 28 2026.
The FBI states under oath that the court has already determined that a criminal investigation of Nigerian President Bola Tinubu was officially acknowledged. The firm says this is a sworn declaration submitted by the FBI to a United States federal court stating that Nigerian President Bola Tinubu was criminally investigated in connection with the trafficking of heroin.
The FBI then goes even further to explain why these records qualify for law enforcement exemptions. The FBI states that the responsive records herein were compiled in furtherance of the FBI’s investigation of multiple individuals for drug trafficking crimes.
The firm says it is posting this document to counter the claim made yesterday that President Tinubu was never criminally investigated and is simply following the law to protect his privacy. The firm says that claim is false as shown by the FBI’s sworn declaration.
The papers were filed in Aaron Greenspan versus the Executive Office for United States Attorneys and others, civil action number 1:23-cv-1816, in the United States District Court for the District of Columbia.
The declaration is signed by an Assistant Section Chief of the Record and Information Dissemination Section who also serves as acting section chief. The official is based in Winchester Virginia, has held the assistant post since March 2023, and has served as acting chief since June 2026. The official joined the FBI in February 1999 and earlier served as international operations chief protocol officer, unit chief of the international protocol unit, program manager for the weapons of mass destruction directorate, protocol affairs specialist, research analyst and paralegal specialist.
The official supervises eight headquarters units and two field operational service center units. The section’s mission is to plan, develop, direct and manage responses to requests for FBI records under the Freedom of Information Act, the Privacy Act and related policies. The official says the statements are based on personal knowledge including information provided in an official capacity.
Because of those duties the official is familiar with FBI procedures for FOIA and Privacy Act requests and specifically with the handling of the plaintiff’s FOIA requests in this case. The filing is the FBI’s third declaration in the case and the official’s first. It supplements earlier declarations dated November 11 2024 and February 13 2026 and supports the defendants’ motion for summary judgment while addressing issues raised in the plaintiff’s second motion.
