Darlington Nwauju, a prominent member of the All-Progressives Congress (APC) and the embattled spokesperson of the party in Rivers State, has contested President Bola Tinubu’s authority to contravene court decisions.
Nwauju criticized the recent meeting between the President, Rivers State Governor Siminalayi Fubara, and Nyesom Wike, highlighting that the presidency failed to seek the court’s permission before intervening.
Expressing his views on the agreements reached during the meeting, Nwauju emphasized the existence of valid court decisions regarding the state assembly. He argued that the federal government’s actions were counterproductive as they bypassed proper legal procedures.
According to Vanguard, Nwauju stated, “You cannot decree peace or legislate peace and at the same time set aside a court process without the leave of the court. Did they seek the leave of court because you must do that before this alternative dispute mechanism?”
He questioned the legality of the settlement process, emphasizing the importance of involving all parties, especially those with pending court cases. Nwauju raised concerns about the one-sided nature of the purported agreement, asserting that it potentially contradicts the constitution of the Federal Republic of Nigeria.
In addressing the issue of a valid court order affirming Edison Ehie as the Speaker of the House, Nwauju questioned the authority of those involved to go against a court decision. He concluded by suggesting that the parties engaged in the settlement may have overlooked key legal considerations, particularly in failing to include all relevant stakeholders in the discussions.
